Legal Question in Banking Law in India
Took hand loan,
my father took a hand loan of rupees 1 lakh and gave a cheque of rupees 1 lakh to the banker as surity,
my father has not signed any document while taking the hand loan.
my father expired recently and the hand loan remained unpaid to the banker.
please let me know what would be the consequences of this if he files a case in the court

The banker can sue you as legal heir of your father and proceed against the assets if any of your father in your hands, The Bank has to prove that your father gave the cheque as by way of surety in a court of law.
