Legal Question in Banking Law in India
I hv given my Flat at Dombivili (E) on Rental basis to Mr. Divekar, Party has given by 2 cheque of Deposit amount for Rs.20,000/- & 5,000/- respectively. After 7 days due to some reason the contract has been spoiled as per mutual understading by both parties. As per their demand I have issued Rs.20,000/- cheque to the party against their chq of Rs.20,000/- which is credited to my a/c. Party has given me Rs.1300/- for 13 days rent in cash. but he stayed for 2 more days in my flat & agreed to pay the amount. BUt now he is refusing to give the money as well as electricity bill amount which will be approx 500/-. I am having still ONe cheque of Rs.5,000/- in my hand which is issued by him. So if I deposit this chq, it will naturaly bounce. In such situation what exactly I can do for recovery of my money. And if I take any legal action what will be the expenses that I have to bare like advocate fees etc.
