in india as per banking law , in case of credit card default since its a non secured instrument , bank can have a legal action against the card holder and can the judiciary will issue non bailaible warrant against the defaulter

it is a civil matter but if post dated cheques are given, then after the person does not appear despite there being summons and after that bailable warrant, the court may issue NBWs.
