Instrument
Drawer is entitled to get the return instrument on payment of return instrument but does that mean drawee is legally bind to give return instrument

drawee is the bank. If you have mistaken drawee for the payee, on payment by the drawer on demand by the payee, the latter if required by the drawer is legally bound to return the cheque. If he does not, there is no point in going for litigation on that account as that would be throwing good money after bad money. you should not pursue further questions on this count.

Yes, the drawee may be obliged to return the document against payment.
