Legal Question in Banking Law in India

land problem

my father in law possess agreecultural land.one of his friend failed to paid loan amount. so bank was in position to attach his home so he requested father in law to mortgage his land and took the loan equal to his unpaid loan amount (21lacs). so my father in law signed some bank documents against this land. his friend again failed paid this loan amount & run to america but his brother is still in city. in the year 2007 bank sold this land for Rs. 42lacs as non payment of laon amount. but this transaction still not registred & on recent 7/12 extract their is father in law's name still present. now my question is what can he do for acquisition of said land

The fact that the land records do not show transfer of your father in law's house is of no consequence. what has been sold is sold. Probably the purchaser from Bank auction will have the Sale deed registered soon. Better consult a local lawyer and proceed.

I believe you should approach a local lawyer with all the documents of your case. Because if bank has sold the property by a valid conveyance there is already a transfer in the name of the new buyer. However, the entry in the revenue records will only be a matter of procedure.
