Legal Question in Banking Law in India
i have took a loan from a privet bank at kolkata. i have paid already 85%. due to illness at present i am fail to pay. in that condition the bank applied a 138 case at Gurgaon district court, Haryana. and i received a summon from that. one thing the summon has no case number.
my question is: (i) may a bank can filled 138 except home town, where the bank has many more office in kolkata?
(ii) the Summon has no case number is that falsy?

Mostly Banks will not do foul play. They can raise cause of action, where the cheque was presented for collection.
You have failed to say manner of service i.e. how did received the summon? by post? or Whether u verified the seal in cover?
