Legal Question in Banking Law in India
if the mortgaged property is partitioned by a declaratory suit before it was motgaged and the motgage papers are signed by only one person instead of three then what will be the legal liability of the remaining persons

The shares of those persons who have not signed the mortgage papers are free of the mortgage and they are also not liable.
