Legal Question in Banking Law in India
a person who is signed the cheque on behalf of the company was dishonoured and action under NIA initiated had taken retirement and comapny accepted his request. my quesition is that he is still facing trial or his name was deleted from the accused. He is signed the cheque on behalf of the company was dishonoured due to financial crises. what remedy is available.

He can plead that he was not in charge of the conduct of business of the company and in signing the cheque he was doing so as a servant of the company. It needs careful defence through a seasoned lawyer.
