Legal Question in Banking Law in India

Thank you for asking a question, "i had recieved a cheque from a party in january.It was valid till 21/07/2011.I had presented it to the drawee bank 3 times and each time they returned it with a memo of insufficient balance.however i could not send a notice to the drawer of the cheque.Can i now send a notice to the drawer after the validity of the cheque is over or tell me what i can do?

Yes you can file a case under sec 138 N.I. Act and the cheque is valid for that purpose.

in case one month is over since the last dishonour of cheque, you cannot invoke 138 NI act but you can file a suit for recovery.
