Once a cheque is issued, the law assumes that it has been issued for discharging some debt or legal liability (though this assumption is rebuttable by the cheque issuer by leading evidence). Thus, once you have issued the cheque, it must be honored and if you ask you bank to stop payment, then it would attract a case against you under Section 138 Negotiable Instruments Act. Such a letter can not be routinely written. If this is permitted, then any dishonest person would first buy goods or services on the strength of cheque and then later write to his bank to stop payment. Thus, if you have a very grave and justified reason to stop payment, then only resort to such extreme step. In that case, while requesting the bank to stop payment, it would be better if you inform the bank the reasons as to why you are asking stoppage of payment of cheque.
