Legal Question in Banking Law in India
Myself sanjay pandey I am in bank sir, in 2007 in april some incident happen withme and I have lost rs5 lakhs when i was in cash section. Sir, after 2 days manager put police complain againt me in sec 406. sir, police not properly investigate and put chargesheet againt me but i have request to homeministry up to reinvestigate case again that time my departmental enquiry started and they found me the responsible for loss of rs 5 lakh police again enquiry started but they again file chargesheet bank reinstate me giving two increment cut in my salary and also transfer me from that place during this period i was suspend and joined bank again on dt feb2009. sir, as i told you that police file chargsheet again but after filing the chargsheet i again request for reinvestigation to homeministry up they ordered but they not done investigation but i got information from bank that you joined bank on feb 2009 at -------.
sir, I want to know that when bank reinstated me when he logged complian against me in ipc sec 406. Any effect of that chargesheet which is already in court. kindly guide me.

As advised earlier, you have to defend through a competent lawyer the criminal case filed in court. You can produce the orders in disciplinary proceedings, where you have not been found to have misappropriated the amount but found guilty of only negligence to prove that you have not misappropriated the money and the criminal charge has no basis.
