Sarfaesi Act 2002

after possessing a property thru sarfaesi proceedings, the borrower has entered into a private treaty with the bank and given consent to the bank to sell the property to any one whether sale notice should be given to the borrower ?

The Bank may or may not give notice to the borrower but it is advisable to give notice.

when the borrower has given consent to the Bank to sell the property to anyone the Bank likes, after possession is taken by the Bank,the Bank has to be cautious and give notice to the borrower of the offer received and secure his consent for such sale by private treaty.
