sbi bank fraud under sarfeasi act
Greetings,
my elder brother had taken an education loan under the education loan scheme from sbi bank.

guess what the bank sold of the land by stating that our payments were highly irrerugular.

the bank never sent any legal notice to us.
and we were paying the emi on time.
we were kept in the dark about the action procees being conducted by the bank.
we were paying emi even then.

and guess what the sbi bank statement shows the check have bounced after three years.
thats right check deposited in 2005 shown as bounced in the years 2008.

after three years.

the bank manager says to my father that she has sold the land on purpose and he can do what he wants to do.

there are other irregularaties in the accounts.

i need help as we dont have too much money to fight the case in drt as the drt court requires that we deposit 10 lakhs.

trust me my case is genuine.
the citi bank statements shows no check has bounced while the sbi bank statements shows that the check has bounced after three years.
how is that possible.

is there no honesty in the land.
the manager has sold our plot worth 40 lakhs for 12 lakhs.

complete fraud.

i can give complete evidence please show me a way to get justice.

Your case needs careful examination of the documents your brother, his surety and the history of payments. No off hand and cut and dry solution can be provided without examining the documents and holding personal discussion with your brother, his surety. where is your brother. Which branch of SBI you are finding fault with. We advise you to immediately consult a local lawyer well versed in these matters to advise and assist your brother in the matter. In the matter of choosing a competent lawyer, you may discreetly enquire with the staff of the DRT where the case has to be filed to choose a suitable counsel to assist you in the matter.
