Legal Question in Banking Law in
under section 138 NI Act what is limitation start for filing of the case is
within one month or after expiry of 15 days after one month.
Ex:-
notice served on the accused is 10-09-2010
15 days grace period for payment 25-09-2010
filing complainant within one month starts from 25-09-2010 or 10-09-2010 and give opinion
and also furnish decision to me

section 138 is clear on this. Notice served on 10th Sept. 15 days period expires 25th sept. therefore cause of action will arise on 26th Sept. and one month period will be counted from 26th Sept and limitation expires 25th October.
