on that behalf the buyer issue a cheque and he stop payment of that cheque
what to do

You can serve a legal notice within one month of dishonor of cheque and thereafter file a complaint if the payment is not made within stipulated time. You may read more on sec 138 negotiable instruments act on my website www.karvai.in.
