sir i have problem. i am manufacturer of cloth.my worker wants Rs.20000 money for his home use. but after receiving money he didn't come on work. then he goes to another factory for working . at that time the owner of factroy gives me a cheque of Rs.20000 on my worker's name. cheque is bearer. but now cheque was not passed. what should i do?

Hope that the cheque issued in favour of your ex worker has been endorsed in your favour. If returned for insufficient funds, issue notice by RPAD under Sec.138 of the Negotiable Instruments Act within 30 days of receipt of the return memo from the bank to the drawer of the cheque asking him to pay the amount within 15 days of the receipt of notice. If the drawer does not pay, file a case in the Magistrate's court against the drawer within one month from the expiry of 15 days of the receipt of notice by the drawer.. Take local Advocate's assistance in this regard.
