Legal Question in Banking Law in India

i give chake to one of my party on 19-08-2010 of rupee 10000/- but chake date is 21/08/2010 but the party deposit the chake on 20/08/2010 & bank bounced the chake & chaged 150/- rupee in my a/c can i take any legal action aginest bank for debiting charge in my a/c

if i restrict my answer to your question, yes you may take action against bank for dishonour and the debit if the bank has done it on 20th August. Bank was under obligation to treat it as cheque only on 21st
