Legal Question in Banking Law in India
sir,iam trailing in cheque case,i joined in unregisterd chit concern and paid the chit amount but the party differs in 20000/-if i ask for account he not response properly and not given my blank cheque.and threatned.so i send a legal notice to him to return the signed empty cheque and signed blank promisery bond,while reciveing the notice he issue a legal notice that he give an hand loan for 40000/-to me two years before iam not paid the intreset of 24%per annum for past 10 months. when he apporached me sevral times i give an cheque of 40000/- and assured to put in the bank on mentioned date.so kindly arrange the funds on that date, are it will be dishonuerd.again he dishonuerd my cheque and send another notice arrange funds with in fiffteen days i will repersent again.then he dishonuerd again and file in the court as cheque bounce case.the court send the summon1 year before now argument going. my adovacate had some doubts so please clarify.q-1,issue notice by complainted lawyer notice and complainted petision amount given date not mentioned.kindly give autherty latest,Q-2,not date mentioned in lawyer notice.but in xerox copy date mentioned and filed in the court.it is wrong any autherty.Q-3the complaint recived intimation from is bank through oral.it is valied intimation, sufficient intimation any autherty latest.kindly give details.to dismise the case.
