Legal Question in Banking Law in India

i submitt a cheque of ma mother cheque book,

which was submitted on dated 24-4-2011

as pay as SELF CHEQUE,,,,

there was a problem of 'SIGNATURE DIFFERS' in the cheque, bcoz of that the bank may not return back that cheque.........now the cheque was at bank

they send a letter to my home in the name of mother that;;;; "come immediately to the bank , referance: cheque "

now ma mother at abroad ,so that i came to bank with the letter of bank for return back the cheque....

manager told that , the cheque was only given to the account holder............

if the cheque was not return back from the bank, is there any problem????????.....

what should the bank will do with that cheque??....is there send any notice or letter,??

any problem with the a/c ?? ............

reply from Vishwa Arya

there will be no problem until mother writes a complaint that she never signed the cheque. With age, signature may differ. If she says that she signed the cheque. there cannot be any investigation. Bank by itself cannot do any thing.

.......................................................................................................................

reply from me ----------now the mother at abroad , she came back after 2 years

once the bank send 1 letter that to -' come immediately to the bank'-

i came there but they says that the cheque will give only to the account holder ......

....any problem with this ,if the cheque may not take from the bank and is they send letters or notice to home ????? ......

reply plz.....

it seems you are worried too much. Let Bank sit with it. It will be for your mother. if your mother does not write to the bank, bank cannot do any thing. Or you may ask your mother to write a letter to the bank saying that she is not in India and asking bank to ignore the cheque.
