Legal Question in Banking Law in India
I have submitted a form 15H against FD in Apr 2011 at SBI and also have a stamped acknowledgement. However, I received a letter from the bank last week saying TDS had been deducted against the FD. The branch accepted that their records had not been updated and hence had deducted the tax, but since they had already paid the tax amount to the government, I will have to wait for the refund from the govt. The bank refuses to refund the amount wrongfully deducted.
Kindly let me know if I can proceed against the bank in the consumer court, since it is clearly the bank's fault.

Yes you can make an application to the Banking Ombudsman before going for the consumer court recourse.
