Legal Question in Bankruptcy in India

My name is Rajotabo Dutta from kolkata. I have a personl lone(Rs. 100000/-) from ICICI Bank. I have paid 24 EMIs(Rs. 1,15,464/-) out of 36, loan disburse date was 04/01/2007 and the first EMI hit 02/02/2007.

Now my question is that may the bank suite 138 against me ? although 36 month already passed from the loan agreement date.

And another question is as negotiation the banks are demanding 25 to 50 percent of capital outstanding, I have already pay 15000+ of capital. What I will do now?
