Business Cheating

As per advt. seen in News Paper and after confirming with tele-talks and emails, I have entered into a jobwork business with a Delhi based Company. (Regd.). As per the conditions, they supplied me machinery for choke manufacturing and raw materials, for which I paid Rs.30,000/- and another Rs.5000/- for raw material. As per the terms, they have to take back the finished chokes and make payments for the same. But even after sending 2 consignments of chokes they did not made any payment and now hesitating to give proper replies. As per the MOU, all disputes should be settled throgh Delhi Jurisdiction. Please advise, how can I get back my hardearned money which I invested as per their assurance of a good business deal.

Prima facie, you should notify and file a case against the party, either in Delhi or at your place, depending on where the cause of action arose.

You have to file civil suit or if it is a registered company then you can also approach the company court though liquidation proceedings.

Even though there is delhi jurisdictionclause, you prefer to file suit at your work place, and fight out the companys objection as regards terrotorial jurisdiction. Engage service of expert advocate who can prosecute your case nicely.

send a notice for the amount and non payment or no response file a suit for recovery of the amount

despite of jurisdiction clause you can file case at your place if cause of action can be shown at your place, for which papers of the agreement or contract need to be seen.
