Cheque bounce

If a cheque is bounced due to insufficient of funds, within how many days should I take action?

Please note that within 30 days from the receipt of bank memo and returned cheque, you have to serve a Legal cum Demand Notice under Section 138 of NI, giving accused a time of 15 days to clear the outstanding. Failing which, you can file a criminal complaint within one month after expiry of 15 days.

You need to give Notice to the other party within 30 days from the receipt of Memo from the bank.

The date is mentioned on the memo.

You have to give then a legal notice within 30 days from the date of intimation by the bank and providing the defaulter 15 days time for payment of money. Thereafter, you can file a complaint within 30 days.
