Cheque bounching and cheating case

one vendor had supplied one generator and we paid him the payment later the genset didnt work and he took it for repairs it is almost 8 months he is not in the position to repair and had refunded our money in cheque which has bounced twice and has given a cover letter that he cannot repair the genset so refunded our payment back but the cheque bounced twice, what legal action can we take against him

one you can get the genset changed and second you can file criminal complaint against him
