Legal Question in Business Law in India

competitor

Iam constructing villas and selling it to the customers and along with other features I am also giving one year WARRANTY on the construction which some of my competitors are not giving. Kindly let me know if I can state the same thing in my advertisement on hoardings showing their names and stating that they are not offering the warranty but we are?(which is a true statment known from my sources). Whatwill be the legal restrictions and consequences? will it attract unfair trade practice or defamation suit?

You can give the warranty but in construction business it is quite problem prone. So check it out doubly and go ahead. But by doing this you will also bring lot of headache to yourself and only with more detail the actual advise can be given.

Re: competitor

If the product offerred by you is unique and distinguihable then naming the competitors may be avoided as the product / service would speak for itself, as naming the competitors may not be very healthy and may lead to un-necessary litigations.

Re: competitor

This is possible only thru some Realty Property Survey but not in your advertisement even if you are sure, they can drag you to court to damage their business by 'mis-guiding' public etc. etc. they can stop your advertisement by bringing 'injuction'in defamation/lible case.
