Legal Question in Business Law in India

To whom it may concern:

I am looking to find out if it is legal for me, as a US citizen living in the US, to buy, own, and operate a business (a cotton mill), in India. I know that there used to be regulations against this, but I was not sure if these had changed. Thank you for your help.

you can be a sleeping partner in a partnership concern but you cannot become a director of a pvt ltd or a limited company. you can operate through a reliable indian citizen here.

MR. Rajiv Gupta does not seem to be updated on the subject. The legal position is rather to the contrary.

If you are a person of INDIAN ORIGIN,you may obtain PIO Card which will entitle you to hold and acquire propeprty in India (except agricultural and plantations). There may be no bar in your buying, owning and running a cotton mill after you are granted PIO Card.

All persons of Indian origin who hold passport of any other country (with certain exceptions) will be eligible to apply for PIO Card, if the applicant:

� At any time held an Indian passport

� He/She or either of his/her parents or grand parents or great grand parents was born in and permanently resident in India as defined in the Government of India Act, 1935, and other territories that became part of India thereafter, provided neither was at any time a citizen of any of the specified countries; or

� Is a spouse of a citizen of India or a person of Indian origin covered under the above.
