Dr. Himanshu agrees to perform a certain operation and takes an
advance of Rs. 70,000 from the patient. Later on Dr. Himanshu refuses
to operate. Decide, giving reasons, whether the' patient can, get a decree
of specific performance fr.om the court against Dr. Himashu?

the patient can file a suit for recovery. the patient better no seek specific performance directing the doctor to operate upon him. then Another case would be of medical negligence.
