Indian Partnership Act & Arbitration Act
Can a Partnership firm be dissolved by an Arbitrator from a date different than the date sought for by the Claimant ignoring the notice of dissolution of the firm issued by the Claimant to his other partners thereby ignoring the partnership agreement between the partners which says the partnerhip is ''at will'' ? In other words, Can a clause in a partnership deed, submitting disputes between the partners to arbitration take away a partner''s right to have the partnership firm dissolved by a notice of dissolution when the partnership is ''at will''?
