is it legal to trade in export surplus materials if not is there a legal loophole in india which allows for the sale of branded goods which come under export surplus

Your question is not very clear, you want to sell surplus item manufactured in India for some third party's brand? If yes, you cannot do so. Your contract shall have some provision fro this. Contact a local lawyer.
