Legal Question in Business Law in India
non- receipt of payment
Supplier & buyer is registered from kerala: But office is disposing the stock in hand :
1. we supplied pepper a year ago through tax invoice from kerala ( No jurisdiction mention on Invoice).
2.when we requested for the payment as payment isoverdelayed from our adm office, delhi
3. the buyer, other party accepted our purchase but raised the false bill of sale on us demanded money insisted of paying through their letter
3.On such receipt of letter, Immediately through telegram from bihar as I was in roaming, we inform them our office has neither placed the order nor taken delivery- please file FIR at your end.
4. no reply of telegram of telegram
5. we again requested for the payment after two months through the regd letter with AD from bihar
6. no reply of letter dated 19.06.2008 though their office has received on 25.06.08
kindly suggest legal step to recover my money as the buyer has malafide intention not to pay.
Please advice from where to file the case as i am mostly staying in bihar & Delhi for my work.

File a civil suit and/or criminal proceedings.

you may have to file suit, you can file suit herein kerala or else you may file suit where buyer permanently situated.You may also move for attachement of his propoerty or belonging when you file such suit.
