Re : Provident Fund

Sir,

I have a question that a Company has got a Showroom and the affairs is looked after by its Commission Agent, recently the Company has increased the Commission to his Agent so as to enable him to pay the Staff Salary and whether the Company can escape its liability from paying Provident Fund or the Commission Agent has to pay the Provident Fund.

Irrespective of employer/or agent. On whose pay rolls you are there is important. If such pay rolls are more than 20 employees. He should pay PF.

The payment of PF and other dues depend upon employer-employee relationship. If the company has hired you through an agent, you may not be entitled to claim anything from the company.

Provident fund is to be paid by the person who is an employer of the employees. If the employer is the company then the company cannot avoid its liability to pay PF.
