Legal Question in Business Law in India
Q. No. 1. Few persons were recruited on 89 days basis, in a Public Sector Undertaking in a workman category and they are serving as 89 days workers since last 5/6 years. But their services were not regularized . They had demanded to regulaise their services, but the management failed to do so consequent to which they had resorted agitation viz wearking black badge, Dharna, pen/tool down. Now the question is whether these 89 days workers are entitled to get salary for the days they have not worked due to pen/tool down strike. Please also specify the provision of the Law/Act.
Q. No. 2. Due to the lapses on the part of the contractor, the work was delayed and accordingly, the concerned department has issued a show cause notice to the contractor stating inter- alia why the contract was not terminated. The contractor did not reply the show cause notice within the time and made a requeste to allow time extension. The technical department has duly recommended for time extension without giving any observation upon the said show cause notice. Now, can a department grant time extension for completion of the work.
