Sarfesai act...

Sir,

our is sme unit... Bank issued sardesai act notice under 13(2) in 26 oct 2007.... Thearafter we process for re structuring and re scheduling but bank regret all our efforts... Finally we gave reply for 13(2) notice on 4/08/2008... Alongwith ots amount for settelment.... Bank not reply so far just one ack letter sent that your ots forwarded to cirle office.... Thearafter bank not reply and suddenly. On 17 11 2008 they came to factory and taken physical possession... Without giving any prior intimation... My unit is running and having 9 workers... Now sir... Wht i have to do..????

File a suit in Civil/D.R.T. Courts.

Generally bank cannot do so without prior notice. Local Banking Lawyer may solve your problem after going through all documents.
