Legal Question in Civil Rights Law in India
From last 34 years we have a shop on rent in a complex, wherein 6 shops are there on the ground floor, office on first floor and the terrace and go down on 2nd floor. We paid the rent very regularly. We run a business here.
From the year 2003 to 2010, we have increased the rent 4 times, on request of the landlord.
In the year 2003 the rent was Rs.500, and was increased to Rs.1000/-
In the year 2006 the rent was increased to Rs.1500/-
In the year 2008 the rent was increased to Rs.2000/-
The rent has increased drastically from the actual rent, during the last many years. The landlord asked to increase the rent on the pretext of many reasons these are :
The services of Washroom are not available in the complex building, and he wants to provide a Washroom facility.
The local taxes have increased and he is not able to manage the same.
But, this is noted that the landlord has never provided any facility for Washroom, and after repeated request to enable the facility of Washroom, the landlord never provided.
Also, I am a heart patient, and I don�t want any tensions, So, I agreed to increase the rent.
In recent days, we received a notice from the advocate, for evicting shop. This may be noted that the landlord runs a business in the same complex, and he stated that he needs the shop for maintaining the stocks for his business and also for expansion, he stated this under Section 16 of Maharashtra Rent Control Act 1999.
My wife and I runs a Business, and we have established a good reputation in the local market, landlord also wants to start the same business, and wish to take over the good will & market established here since more than 25 years. We do not have any other business source, apart from this business, we have two sons, both are studying and are preparing for Management studies. The shop is the only bread and butter of me and my family, and also feeding 10-15 labors that work on daily basis, and are paid on daily basis.
After struggling for many years, we are able to reach here. My age is 56, and my wife�s age is 50.

you may defend the eviction petition on the ground that you are paying rent on time and there is no ground on the basis of which the landlord can evict.
