Legal Question in Civil Rights Law in India
hello all.
the common wall between our plot and our neighbours' plot is built partially on both his land and mine. recently, I built first floor for which i did the following:
1. built RCC beam on the old common wall to strengthen it.
2. built the new wall above the old common wall for the newly constructed first floor.
now my neighbour has used this wall to build first floor on his plot. the roof has already been laid down. however, he has refused to pay for the RCC beam mentioned above citing the cause that i built the beam for my purposes(strengthening the old wall) and so he should not pay for it but is willing to pay for the new common wall.
is he right?
can i take some legal action against him?
