Legal Question in Civil Rights Law in India
I have applied 4 times for the OBC certificate of my son named PRATEEK KUMAR in the office of SADAR TEHSIL, DISTRICT-ALLAHABAD, UTTAR PRADESH with prescribed fees and supporting documents in order to issue an OBC certificate (Caste Kandu) in the name of my son. Sir, I have submitted application along with (i) Affidavit on the prescribed format (ii) Certicate from Ward Counsellor certifying the caste, (iii) School T.C. certifying the caste, (iv) photocopy of ration card, (v) Khasra of our house, (vi) receipt of house tax paid every year to Nagar Nigam (house tax being paid since 2004), (vii) receipt of water tax bill paid to Allahabad Jal Sansthan, (viii) 4 OBC certifates issued by this office for the same caste, (ix) Central list of OBC for Uttar Pradesh having "Kandu" mentioned at the website �http://ncbc.nic.in/backward-classes/up.html� and (x) State Govt list of OBC having Kandu. Sir, I have been appying 4-5 times since 07.07.2008, but everytime they reject it and I could not get the certificate in the name of my son. When I asked the reasons for rejection of application, the Lekhpal told me that this caste "KANDU" is not found in Allahabad and hence address of "MOOL NIWAS" is required wherefrom it will be enquired about your caste and he also asked me to submit "SEWA PUSTIKA". Then I told him that I have been residing permanently in Allahabad since last 10-12 years as per documentary proof and we are resident of Allahabad having house in my name and my son have been studying in Allahabad since last 10 years. In spite of all these things, the Lekhpal/Tehsildar is rigid to his points and has refused to issue OBC caste certificate in the name of my son. Sir, my son has appeared in Entrace Examinations for Admission in engineering colleges and has mentioned his Caste Category "OBC". But if he is selected and does not produce/submit his Caste Certificate during Counselling, then his admission will stand cancelled. Hence, the OBC caste certificate is very much required by us, otherwise his career/ future will be spoiled and it is a fact that he deserves this OBC caste certificate. Please guide me and advise me in this matter.

You may approach the higher authorities like the Collector of your area; or consider initiating legal action through a local lawyer.
