Legal Question in Civil Rights Law in India
My brother is missing since 1955,at the age of 20years,that time no birth was registered in panchayat or school,but at the time of partion of fathers property 1973,his propery was kept under the custody of elder brother(died-1985),we would like to legally divide his property,what to do ?

You need to file a Declaration suit for declaring the person as dead. And then can get the Legal Heirship Certificate and divide the property.
