i am in chandigarh.i got speed post summons from lok adalat,distt. court,chandigarh.

the icici bank is harrassing me a ;lot.i wote different name on speed post paper.no aknowledgement was there.earlier too,icici bank send summons from lok adalat.i did not appeared 2 year back

actually,they want to recover credit card dues illegally from me.

i have learnt that lok adalat decision is based on the amicable settlement of both parties.

now,can the the lok adadat compel my presence.

if there is any dispute,i opt for civil case.

i want to ignore these summons as only reader has signed and all drafted by icici bank.

can lok adalat issue warrants.

i do not want any settlement with icici bank.

If you did not appear then lok adalat will not send any arrest warrant but the case will be move back the court for regular hearing and there bank can recover the money even after selling your property or by any means from you or form your surities. Moreover summons are always sign by reader only.

You may file a civil suit against the bank for settlement of account.

If it is a pre-litigation lok adalat notice, nothing will happen if you ignore the same. But if already a suit has been filed by bank and the same matter has been referred to lok adalat, your absence may redirect the case back to the court, where separate summons are served.

If you have substantial grounds of being harrassed by bank, you may approach Consumer Forum. But, marking your presence before the lok adalat will not be against your interest because the award is passed when both the parties agree upon the settlement and you will have an opportunity to clarify your stand at lok adalat.
