Legal Question in Civil Rights Law in India
A civil suit was filed in 2006. Notion of motion was moved by the plaintiff and an order of exparte injunction was passed. If we , the defendants want to move a notice of motion now in 2011 for disposal of case for lack of jurisdiction or to bring to the knowledge of the court that the documents submitted by the plaintiff are forged, is it possible ? Can defendants also file a notice of motion after 5 years ?

notice of motion is nothing but serving of copy of plaint to the defendents .what u need to do is file an application to set aside the exparte injunction order . there u can take ground of lack of jurisdiction or other .
