Cooperative Housing Societies Act
We are 16 members of a cooperative Housing Society at Akurdi, Pune Maharashtra, India.In one of our meeting we decided to get the flooring work done in the parking area as there was no Surfacing done by the builder. We reside here for the last 14 years. The Special meeting held for the purpose we decided to get the job done by a majority vote. As is often the case two of the members have refused to pay the amount.What can we do. Can we proceed legally against them and what will be the consequences?

When a person becomes a member of the cooperative housing society then all the costs incurred by the cooperative society on any land (including its development costs) shall be apportioned between the members of the society in such manner as be decided by the Board of the society.The members who have violated the rules of the society by refusing to contribute to such developmental costs may be sent notice and thereafter a suit for recovery can be filed against the members by the society.

The society should first formally send them a notice for the amount payable.If they refuse to pay then you can file a suit against them in the cooperative court.It may take time but ultimately you will be able to recover the amount.
