when couple have been expired without leaving any will and they have no legal heir person who did last rites will be consider as legal heir to claim the property

No for this one needs to refer to Schedule under the Hindu Succession Act, And Class I heir shall take together and the absence of Class II Heir, Class II Heir shall succeed in the order of their respective entry in the Schedule.
By performing last rights - one does not become Legal Heir.
