CPC Order XXII
The mother is the 1st defendant and the son is the 2nd defendant. Son died. Is it necessary to implead the mother as the legal heir of the deceased son in the same suit?

as mother is already there so leave her and implead other heirs of the son

you can file a memo to take her as the legal heir of the son

Its not necessary untill and unless the son has not left with a will or his legal heirs like wife etc.
