Legal Question in Civil Rights Law in India

Cr. P. C 340

My wife has filed a Domestic violence case against me and using that she locked my bank accounts & properties. Along with that she also locked my mother's bank accounts and properties by falsely claiming that they belong to me. In her petition she explicitly mentioned that my mother's accounts as my accounts. As my wife has made a false claim can I user Cr. P. C 340 to book a case against my wife and ask judge to punish her under IPC section 193 (Punishment for false evidence) and 199 (False statement made in declaration which is by law receivable as evidence). Please advice.

yes, in case she has claimed your mother's locker to be hers EXPRESSLY in her own complaint or petition, you may move an application u/s 340 of crpc.

I would strongly advise you to manage an out of court settlement and close the transaction at one go.

Yes, complaint may be lodged against her if you have sufficient and preferably written proof against her. Can you think about compromise?

You should forget about 340 and 199 and instead concentrate on your defence.

It may be better for you if you could manage an 'out of court settlement' and try to close the entire chapter in one transaction. However, multiplying litigation may not help you.
