Legal Question in Civil Rights Law in India

Dear Sir,

A person issued DD for Rs. 5 lakhs in my name. I got the first DD back saying - 'Refer to the drawer'. That person stopped this DD by giving indemnity bond and got a duplicate DD. After some days he expired.

On approaching court at time of expiry of DD, came to know he is dead. Now, his parents says they dont have the DD but are claiming this amount saying that they are the legal heirs. I have document proof saying that the DD was issued on my behalf towards returning back of my money which he got from me through bank account transfer.

The above case is running in our chennai civil court for the past 2.5 years. This case is getting adjourned without progressing even a step (Reasons being their advocate being absence or judge being absence or party not well and so on).

Is there a way to make this case progress further? I am currently paying high interest for the above personal loan. The person failed to fulfill his promise and more than that they are holding my money by claiming and dragging me for years. Will anyone be able to help me on this?

Is there no time limitation to get a case solved in our Indian courts?

Thanks

Hema

you may ask the court for early hearings as you are on the stronger footing.
