Legal Question in Civil Rights Law in India

Dear Sir,

First of all thanks a lot, for having this way of communication.

There quite a few question.

Instead of telling entire story, I will try to ask direct

question.

I had a contract/bond with my college(where i was a lecturer )

that they will sponsor my M.tech programme and for that I will be teaching in college for 2 year once i complete my M tech.

Contract took place in July 2011

1. Now for this they took an undated cheque on 2 Lakhs, in case, I break this bond but they did not gave a a copy of that bond.

Is point 1 legal? Is it correct not to give a copy of bond?

Is it correct to take undated cheque ?

Now second .

They did not pay for my M.tech, instead they allowed me half day leave to do my Mtech.

Since I had taken admission, I had to pat for 1st semester and still paying as I am in 4th semester.

Now doesn't it void the contract ?

They have not fulfill their promise, so does the contract stand ?

Because of this i left the college and now they are sending me legal notice, threatening that I have broken the contract and they will in-cash the cheque, but I have no money in my account,

what will happen?

Please suggest ?

What can I do?

Dhanywad, Hoping for reply.

Dear Sir / Madam,

(Coimbatore, Tamil Nadu)

I am unable to reason out as to why you gave the undated cheque of Rs. 2.00 lakhs to the college, as you say that you have paid the M.Tech fees yourself from the 1st to the 4th semester. Since you say that the college allowed you half a day's leave, it is important to know whether you were engaged as a lecturer in the college for half a day since July, 2011 or prior to that period, and were you being paid salary by the college for rendering the lectures ? If yes, was the fact of engaging you as a lecturer a part of the bond ?

1. The college has taken the undated cheque as a security from you to complete your M.Tech and teach in the college for a period of two years thereafter. Yes ... they ought to give you a copy of the bond. Have you signed the bond ? It is worthwhile for you to still ask the college in writing for a copy of the bond.

2. Was it initially agreed that the entire fees of your M.Tech will be borne by the college and do you remember or recall that the clause to this effect has been mentioned in the bond that you signed ? Did the college official also sign the bond in your presence ?

Please mail me answers to the above questions at [email protected]
