Legal Question in Civil Rights Law in India
Dear Sir,
My ancestor property was divided in court (Mysore trial court, Karnataka) by preliminary decree (dated 31.01.2005) stating that 5/12 share in all the property but now (ie 1.1.2013) my sisters applied to court for equal share in all the property according to Hindu succession (amendment) act 2005.My question is:
1.Can they challenge the preliminary decree after 6 years moreover they have signed for all the mahazar in front of the court appointed civil engineer during partition.
2.they are married 45 years back .legally do they have rights to claim after preliminary decree?
