Legal Question in Civil Rights Law in India
Dear Sir
So, I think i should go for the DNA test of my son rather than applying for the Declaration for legally married wife as in my DV Act case My husband has asked for the submission of declaration of legally married wife from my end.
Sir, this is very crucial time in my life and i want to safe guard my family as my husband is a rich person n he is tryin to make it longer for us to get justice. We have all the evidences in our favour but of no use as we cant claim any thing from him now.
We have applied for the enhancement of maintenance but it is pending since 1 year so please Suggest some ways to that our point gets much stronger and even in the case of his death our interest can be protected .
In every case he is just denying the relations with us and it lies pending in the court since the last 6 years almost every case is lying pending.
Please Suggest as this is most precious time of my life as we both r old and we are on the edge of death.

It is not clear why you want DNA test for your son. Is it because your husband disputes marriage with you? If the answer is yes, then DNA test can indeed prove biological fatherhood but proof of marriage is different.
Request your lawyer to expedite the maintenance case.
