Legal Question in Civil Rights Law in India
Dear Sudershan Goel Sir
I have obtained maintenace on charge and stay on certain plots of land of my husband in a civil case. My husband is denying having any relations with me but i have all the evidences like marriage photos,id and address proof and maintenance order under section 125 CRPC of Rs.500/- p.m in 2002 . My husband has paid this maintenace amount for certain months and he has not paid it since the last six Months. Now i have applied for its enhancement and my application is pending since one year
I was working as a school teacher in a private school but i was not on duty since the last 2 years and i have also recently resigned from that school six months back .
My husband has obtained the details of my service my salary details etc through RTI one year back from that school where i was a teacher 2 years back and i have resigned six months back and have taken letter that i have not taken salary while not on duty since the last 18 months .But nowi have left that school and m residing at my home .
I just wanted to know will this RTI Report of my Service (School teacher job where i was on duty 2 years back and have taken the letter for not attending the duties for the last 18 months and i have recenty resigned six months back also) affect my mainteance under 125 CRPC which was granted me in 2002 for the maintenance amount of Rs.500/-p.m.
.
Simply i wanted to know will my 125 CRPC mainteance order passed in 2002 for Rs.500/- p.m.will be affected by this RTI report which was submited in court recently by my husband .
if not , is there any specific ruling which we can take the reference in my case . Sir I am from a small village where the lawyers are not so much knowledgeable , If there is any specific ruling for it ,please let me know so that i can help my lawyer and justice can be done.

the amount of Rs. 500/- is so meager that even if the report is placed in the court, the court may not even consider denying you the same. however, if your husband is earning well, you may go for enhancement of maintenance.
