Legal Question in Civil Rights Law in India
A is a debtor . he borrowed money from various people in chennai' he obsconded for a month. Now he sent a summon from madurai Sub Court(300km from Chennai). by filing a insolvency petition(IP) and asked the various creditors to come and attend the court on 02.03.10. Kindly clarify with relevent provisions of law and also inform whether we can recover the amount by filing a case under section 138 of NI act.

The insolvency petition may not bar proceedings under section 138 of N.I. Act.
