declaration of legal heirs

how can the court declare a deceased party as a legal heir against all concerned

acutally a dead person cannot be declared legal heir. if there is no legal heir than the property will become escheat. i.e. it will go to government.how if there are legal heirs of deceased persons such persons can be made party to the suit and than can be declared as legal heirs of legal heirs

No, Court will not declare the dead person as legal heir. may be because of misrepresentaion couurt might have declared so. you can make an applicaiton and with docuemtnary evidence so as to the said person is dead (death certificate) and bring it to court notice.
